Donor Privacy

The Community Foundations is committed to protecting the privacy of our donors. We have developed this privacy policy to ensure you that your information will not be unnecessarily shared with any third party.

The Community Foundations does not sell, rent, lease, or share donor list information with other organizations. We may from time to time list your name publicly as a donor unless you explicitly choose to remain anonymous. If you make a donation to a fund, your name, address and gift amount will be shared with the fund advisor unless you request otherwise.

Awareness. The Community Foundations provides this Donor Privacy Policy to make sure you are aware of our privacy policy and to inform you of the way your information is used. We also provide you the opportunity to remove your name from our mailing list, if you desire to do so.

Information collected. Here are the types of donor information that we collect and maintain:

  • Contact information: Name, organization, complete address, phone number, email address, and address history.
  • Payment information: credit card number and expiration date, and billing information. Credit card numbers, expiration dates and billing information are used only for donation or payment processing and are not retained.
  • Information concerning how you heard about the Community Foundations
  • Information concerning your attendance at our events
  • Your history of giving to the Community Foundations (e.g. the date and amount of your gift, and the fund(s) to which you contributed).
  • Summaries of substantive conversations with Community Foundations staff.
  • Information you choose to share: questions, comments, suggestions
  • Signed gift and fund agreements and other related documents. How information is used Donor contact information and detailed gift history are kept on file for IRS purposes.

Details of the largest contributions in any given year must be disclosed on the Community Foundations’ IRS tax form 990, but are not publicly disclosed. The Community Foundations uses your information to understand your charitable interests and provide you with better service. Specifically we use your information to help you complete a transaction, communicate with you and update you on Community Foundations news.

Acceptance of Terms of Use

This Terms of Use Agreement (this “Agreement”), states the terms and conditions under which you may use this web site (the “Site”).  Please read this Agreement carefully.  This Site contains various information relating to Community Foundations of the Hudson Valley (“the Community Foundations” or “We”) in the form of text, graphics, news, reports, and other materials (tangible or intangible) (“Content”).  By accessing, browsing and/or using this Site you acknowledge that you have read, understood and agree to be legally bound by this Agreement.  If you do not accept this Agreement (and therefore do not agree to by bound by this Agreement), do not use this Site. We reserve the right to amend this Agreement at any time by posting the amended terms on our Site.

You shall not store electronically any significant portion of any Content. The Community Foundations authorizes you to view and use the Content on this Site solely for your personal, noncommercial use. The Community Foundations reserves the right, in its sole discretion, to restrict, suspend, or terminate this Agreement and your access to all or any part of our Site or the Content, ay any time and for any reason without prior notice or liability. The Community Foundations reserves the right to change, suspend, or discontinue all or any part of this Site or the Content at any time without prior notice or liability.

User Must Comply with Applicable Laws

This Site is based in Poughkeepsie, New York. The Community Foundations makes no claims concerning whether the Content may be downloaded or are appropriate for use outside of the United States. If you access this Site from outside of the United States, you are solely responsible for ensuring compliance with the laws of your specific jurisdiction.

Miscellaneous

In the event that any portion of the Agreement is held to be invalid or unenforceable, the invalid or unenforceable portion shall be construed in accordance with the applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the Agreement shall remain in full force and effect. The paragraph headings herein are provided only for reference and shall have no effect on the construction or interpretation of the Agreement. The Community Foundations’ failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of its right to subsequently enforce such provision or any other provision of this Agreement.  Neither the course of conduct between parties nor trade practice shall act to modify any provision of the Agreement. The Agreement shall be governed by and construed in accordance with the laws of the State of New York, except with regard to its conflicts of law rules.  Any action relating to the Content, Site or this Agreement must be brought in the federal or state courts located in New York, and you hereby irrevocably consent to the jurisdiction of such courts.  Any cause of action you may have with respect to the Content, Site or this Agreement must be commenced within one (1) year after the claim or cause of action arose, or be barred. This Agreement contains the entire agreement of the parties for this Site and supersedes all existing agreements and all other oral, written or other communication between the parties concerning its subject matter. You agree to use the Content and Site only for lawful purposes. You are prohibited from any use of the Content or Site that would constitute an illegal offense, give rise to liability or otherwise violate any applicable local, state, national or international law or regulation.
